Using EEQ-8

Terms of Sale and Licence

EEQ-8 is sold through Lemon Squeezy, which acts as the merchant of record. Lemon Squeezy is the seller for your purchase — the order, payment, invoice and any refund are handled under their terms. This page governs only what you may do with the software: the licence between you and NEVER FOUND.

Sections 1 to 10 are about the paid product. NEVER FOUND’s free plug-ins are covered by section 11, which says which of these terms apply to them.

Kerf, the video editor, is covered by Part B; the same text is at account.neverfoundaudio.com/terms.

LF-Pro is not covered by these terms at all. It is distributed only through MuseHub and licensed to you under the end user licence agreement shown on its MuseHub listing; MuseHub is the seller and handles order, payment and refund under their terms.

A German version of these terms exists and, for consumers resident in the EU, is the version that applies. This English text is provided so buyers elsewhere can read the same terms in plain English.

1. Who you are dealing with

EEQ-8 is developed and licensed by Maksym Wieslaw, trading as Never Found Audio and using the mark NEVER FOUND, Brookstraße 2a, 49685 Höltinghausen, Germany. Contact: info@neverfoundaudio.com.

Your contract of sale is with Lemon Squeezy, not with NEVER FOUND. Your licence to use the software is with NEVER FOUND, on the terms below.

2. The licence you get

NEVER FOUND grants you a perpetual, non-exclusive licence to use EEQ-8 for its intended purpose. One licence activates the software on one machine at a time. You may move the active machine as often as you need — contact support and it will be switched over.

You may use EEQ-8 on commercial work, including music you sell, without paying anything further. There are no royalties and no per-project fees.

3. What you may not do

You may not rent or lend the software, share your licence key so that more than one person can use it at the same time, or attempt to defeat the licence check. You may not reverse engineer, decompile or disassemble the software except to the extent applicable law expressly permits despite this restriction.

You may transfer your licence permanently to someone else where the law allows it. If you do, delete every copy you hold and tell us, so the licence can be reassigned.

4. Licence check

EEQ-8 verifies its licence over the internet. When the plug-in window is opened while online it renews its licence at most once a day; without a connection it keeps running fully offline for up to 45 days. What is transmitted is described in the Privacy Policy.

5. Updates

Updates are included in the purchase price and are provided at no extra charge. That covers all versions of EEQ-8, including major version changes. There is no upgrade fee and no paid “Pro” edition.

6. System requirements, and the trial

EEQ-8 is currently offered only as a 64-bit VST3 plug-in for Windows 10 or newer. There is no macOS version. Please check before buying that your system meets these requirements and that your host application loads 64-bit VST3 plug-ins.

The easiest way to check is the free trial: every feature for 14 days from the first activation, one trial per computer and per email address, and at most two per internet connection within 30 days. The trial key is emailed once you confirm your address on the trial page, which also puts you on the NEVER FOUND newsletter; you may unsubscribe at any time and the trial keeps running. The trial ends by itself: nothing is charged, nothing renews and no purchase contract comes about. After it ends, EEQ-8 can only be used with a purchased licence.

7. Disclaimer of warranties

The software is developed carefully and to the current state of the art, but it is provided “as is”. To the fullest extent permitted by applicable law, NEVER FOUND disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. No warranty is given that the software will run without fault in every possible combination of hardware, operating system and host application.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits a right you hold that cannot be waived under the law of your place of residence.

8. Limitation of liability

To the fullest extent permitted by applicable law, NEVER FOUND is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost recordings or lost data, arising from your use of or inability to use the software. Where liability cannot be excluded, it is limited to the amount you paid for the licence.

Nothing in this section limits liability for intent, gross negligence, injury to life, body or health, or any other liability that cannot lawfully be limited. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

Keeping backups of your own projects and data remains your responsibility.

9. Refunds

Refunds are handled by Lemon Squeezy as the seller. What applies to you depends on where you live, and is set out in the Refund Policy.

10. Governing law

These licence terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside. For buyers in the United States, your state’s non-waivable consumer protections continue to apply regardless of this clause.

11. Free plug-ins

NEVER FOUND also gives away plug-ins at no charge — currently VT-Mini. Nothing is bought, so there is no order, no invoice and nothing to refund, and Lemon Squeezy is not involved. They are obtained by confirming an email address on the newsletter, and the download link is emailed to you. A working address is required: signups from disposable-mail providers are refused, because the plug-in is given in exchange for joining the list, and a throwaway address is not that exchange.

You get a perpetual, non-exclusive licence to use them for their intended purpose, on as many of your own machines as you like, including on commercial work you sell. There are no royalties and no per-project fees. There is no licence key and no licence check.

What you may not do: redistribute them, host the installer anywhere else, or include them in anything you sell or give away. Send people to neverfoundaudio.com instead — that is where the current version always is, and where the published checksums are. The restrictions on reverse engineering in section 3 apply.

Sections 7 and 8 apply in full. A free plug-in is provided “as is” with no warranty, and the liability limits in section 8 apply to it as they do to the paid product. Sections 10 and 12 also apply.

A free plug-in may be withdrawn or discontinued at any time. That does not affect a copy you already hold, which stays yours to use.

12. If part of this is unenforceable

If any provision of these terms is or becomes invalid, the remaining provisions stay in force.

Part B: Kerf Terms of Use

As of 14 October 2026. The German version (Lizenzbedingungen, Teil B) is the binding one; this is a translation. The same text is at account.neverfoundaudio.com/terms.

K1. Who, and what these terms cover

Kerf is video editing software by Maksym Wieslaw, trading as Never Found Audio ("NEVER FOUND"). The address is in the Impressum. These terms cover your Kerf account and your use of the software.

You buy the subscription from Lemon Squeezy. Lemon Squeezy is the seller (merchant of record) and your contract partner for the order, payment, invoice, sales tax, refunds and withdrawal; its terms, shown at checkout, apply to those.

K2. Account

Kerf needs a Kerf account at account.neverfoundaudio.com. One account belongs to one person. Keep your password secret; you can also turn on sign-in codes from an authenticator app.

Kerf is for people aged 16 and over. Under 18, a paid subscription needs a parent's consent.

K3. Subscription and prices

Kerf costs €7.99 a month or €69.99 a year. Lemon Squeezy shows the final price and sales tax at checkout. The subscription renews automatically for another month or year until you cancel.

K4. Free trial

New customers can try Kerf free for 7 days. You enter a payment method when the trial starts. Unless you cancel before the trial ends, your chosen plan starts then and the first payment is due. Cancel before, and nothing is charged.

There is one free trial per person, per computer and per email address. If it was already used, there are no free days: Kerf unlocks only with the first payment, even if the checkout shows a trial.

K5. Cancelling

You can cancel at any time, effective at the end of the current billing period, without giving a reason:

  • without signing in, at Verträge hier kündigen (cancel here),
  • signed in, under "Manage subscription" on your account page,
  • by email to info@neverfoundaudio.com.

"Verträge hier kündigen" first sends a link to the subscription's email address, so nobody can cancel someone else's subscription; clicking "Jetzt kündigen" (cancel now) on that link's page declares the cancellation, and a confirmation goes to you by email at once. For the other ways we confirm by email too. Kerf keeps working until the end of the paid period; nothing is charged after it. Periods already paid are not refunded pro rata unless the law says otherwise. The right to terminate for good cause is unaffected.

K6. Right of withdrawal

As a consumer you have a statutory 14-day right of withdrawal. It applies against Lemon Squeezy as the seller; you receive the withdrawal information at checkout. Send withdrawals and refund requests to Lemon Squeezy, or to info@neverfoundaudio.com and we pass them on.

K7. Licence

For as long as your subscription (or trial) runs, you get the simple, non-transferable right to use Kerf as intended on up to 2 computers at a time. For a third, sign one of them out on your account page first.

The videos you make with Kerf are yours, including for commercial use. Sharing your account, getting around the licence check and reselling Kerf are not allowed. Your statutory rights under §§ 69d, 69e of the German Copyright Act are unaffected.

K8. Licence check and internet

Kerf checks your subscription when it starts and every 6 hours while it runs. Offline, it keeps working for up to 7 days on its last check (up to 3 days during a trial or after a failed payment), then needs a connection again. A computer that hasn't checked in for 90 days is signed out. Kerf needs the internet to sign in, for the check, for updates and to load some features the first time (speech recognition, music detection, voice separation). The privacy policy says what is sent.

K9. Your content

Your projects and media stay on your computer; Kerf doesn't upload them. Only what you send yourself leaves it: a problem report (F7), which includes Kerf's log and a screenshot of Kerf's window unless you untick them, and, when you connect Claude to Kerf, the frames and text Claude works with. You are responsible for the rights to the media you edit (music, for example). Kerf's music check only shows where music plays; it doesn't check rights.

K10. Updates and changes

While you subscribe, you get updates at no extra cost, including those required by § 327f of the German Civil Code. Kerf may be changed beyond that for a valid reason (new operating systems, security, technical progress), at no extra cost to you and with clear notice. If a change affects your use more than marginally, you may cancel free of charge within 30 days of the notice (§ 327r of the German Civil Code).

K11. Blocking

NEVER FOUND may block an account for good cause, in particular for getting around the licence check, sharing the account, abusing the trial or unlawful use. As a rule you get a warning by email first, unless that is unreasonable in the case at hand. If an account is blocked through no fault of yours, we refund what you paid for the blocked time pro rata.

K12. Deleting your account

You can delete your account on the account page at any time. A running subscription is cancelled to the end of the paid period first; if it can't be cancelled, the account isn't deleted, so nothing keeps billing. Your projects on your computer stay.

K13. System requirements

Kerf runs on Windows 10 and 11 (64-bit) and on macOS 13 or later on Macs with Apple silicon (M1 or later); Macs with an Intel processor aren't supported at the moment. Please try Kerf on your computer during the trial.

K14. Defects

The statutory rules apply, for consumers in particular §§ 327 et seq. of the German Civil Code on digital products. Kerf is built to the state of the art; it isn't promised to work without errors in every possible combination of hardware, operating system and media.

K15. Liability

NEVER FOUND is liable without limit for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For simple negligence, liability exists only for breach of an essential contractual obligation (one that makes the contract possible and that you may regularly rely on), limited to the foreseeable damage typical for the contract. You are responsible for backing up your projects; Kerf helps with "Back up projects".

K16. Changes to these terms

If these terms change, we tell you by email. For a running subscription the new terms apply only once you agree; otherwise the previous terms apply until the subscription ends.

K17. Law and final provisions

German law applies, excluding the UN Convention on the International Sale of Goods. For consumers this choice of law applies only so far as it doesn't deprive them of the protection of mandatory rules of the country where they live. If a provision is invalid, the rest remain valid.
